AWS BYOL 092016 

 QLIK(r) AWS BYOL END USER LICENSE AGREEMENT 
1. Applicable Agreement. Licensee may use the Qlik Sense(r) Enterprise Software ("Qlik Software") as a BYOL on AWS Marketplace only in accordance with the end user license agreement that governs Licensee's use of the Qlik Software ("Agreement"), as modified by these terms and conditions ("Additional Terms"). Use of the Qlik Software is expressly conditioned on Licensee's compliance with the terms of the Agreement and these Additional Terms. By using the Qlik Software on AWS Marketplace, the user represents that user is duly authorized to legally bind Licensee to the terms of the Agreement and these Additional Terms. The Agreement and the Additional Terms constitute the entire agreement for the use of the Qlik Software as a BYOL on AWS Marketplace. 
2. Limited License. Subject to Licensee's compliance with the Agreement and these Additional Terms, Qlik grants to Licensee a limited, non-exclusive, non-transferable, non-sublicensable license to use the Qlik Software within Pre-Installed Images that deployed in AWS Marketplace for its own internal business operations. "Pre-Installed Image" means a virtual machine image offered by Qlik in which the Qlik Software is pre-installed. 
3. Use within AWS. Licensee may use the Qlik Software only within pre-installed images that qlik deploys in AWS. Licensee has no rights or license in any pre-installed images. Licensee may not duplicate the qlik software, or use the qlik software on any other device or system, including but not limited to on-premises computing systems, other virtualized or cloud computing environments, or other AWS virtual machines. 
4. Term. Provided that Licensee complies with the terms of the Agreement and the Additional Terms, Licensee's right to use the Qlik Software will continue for as long as Qlik continues to offer the Qlik Software as a BYOL within the AWS Marketplace. In the event that Qlik elects to discontinue offering the Qlik Software within the AWS Marketplace, these Additional Terms will terminate. Qlik may terminate the Additional Terms immediately in the event that Licensee violates any terms of the Agreement or these Additional Terms. Upon termination of these Additional Terms, Licensee must immediately discontinue use of the Qlik Software on the AWS Marketplace.
